These Terms and Conditions (“Terms”) govern your access to and use of the websites, applications, mobile sites, products, content, listings, features and services operated by Farmjunction Marketing Private Limited and its affiliates, subsidiaries & associated companies, (herein referred as “Farmjunction”, “Company”, “We”, “Us” or “Our”).

By accessing or using the Services, registering an account, submitting an enquiry, posting a listing or otherwise engaging with the Services, user (herein referred as “You”/ “Your”) agree to these Terms, the Privacy Policy and any service-specific terms displayed to you.

THESE WEBSITE TERMS AND CONDITIONS IS AN ELECTRONIC RECORD IN THE FORM OF AN ELECTRONIC CONTRACT FORMED UNDER APLICABLE LAWS INCLUDING BUT NOT LIMITED TO INFORMATION TECHNOLOGY ACT, 2000 AND RULES MADE THEREUNDER AND THE AMENDED PROVISIONS PERTAINING TO ELECTRONIC DOCUMENTS / RECORDS IN VARIOUS STATUTES AS AMENDED BY THE INFORMATION TECHNOLOGY ACT, 2000. THESE TERMS OF USE DOES NOT REQUIRE ANY PHYSICAL, ELECTRONIC OR DIGITAL SIGNATURE.

These Terms and Conditions together with Privacy Policy available at Website, as applicable, and all other notices, rules, guidelines with respect to Your use of Website, constitutes the entire agreement ("Agreement") between Company and You and does not require any physical, electronic or digital signature.

1. SERVICES

Farmjunction provides digital platforms that may enable users to search, compare, enquire about, list, buy, sell, finance, insure, inspect, service or otherwise transact in relation to tractors, agricultural equipment, bikes, cars, trucks, infrastructure equipment and related goods or services. Unless expressly stated otherwise in writing, Farmjunction is a technology platform and a facilitator. Farmjunction is not the manufacturer, owner, dealer, seller, lender, insurer, insurance broker, workshop, inspection agency, transporter or guarantor of any third-party product, vehicle, equipment or service.

2. ELIGIBILITY

You may use the Services only if you are at least 18 years old and legally competent to contract under Indian law. If you use the Services on behalf of an entity, you represent and warrant that you have authority to bind that entity. You must provide accurate, complete and current information and comply with these Terms and applicable law.

3. ACCOUNTS

Certain Services may require account creation, mobile-number verification, email verification, KYC, dealer verification or other authentication. You are responsible for maintaining the confidentiality of your account credentials, passwords and one-time passwords. Farmjunction may suspend, restrict or terminate your account where it reasonably believes that the account is fraudulent, inaccurate, inactive, unlawful, abusive, insecure or in breach of these Terms. When you submit your details through any of website, we may use the mobile number you provide to send you an automated confirmation message via WhatsApp or any other applicable mode.

4. LISTINGS AND USER CONTENT

You are solely responsible for all information, images, documents, specifications, price details, statements, reviews, messages, photographs and other content that you upload, submit, publish or share with us. You represent that the content is accurate, current, lawful, non-misleading, authorised and non-infringing. You grant Farmjunction a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to host, reproduce, adapt, publish, distribute, display and use User Content to operate, promote, secure and improve the Services.

5. THIRD-PARTY PROVIDERS AND TRANSACTIONS

Farmjunction may connect you with independent dealers, sellers, buyers, lenders, insurers, inspection agencies, workshops, OEMs, logistics providers and other third-party providers. You must independently verify identity, ownership, title, registration, hypothecation, condition, documents, compliance, price, finance terms and insurance terms before entering into a transaction. Finance and insurance remain subject to the independent assessment, approval and terms of the relevant lender, insurer or regulated intermediary and Farmjunction holds no responsibility.

6. PRICES, VALUATIONS AND CONTENT

Prices, specifications, mileage, availability, offers, valuations, finance calculations, insurance estimates and other information may be sourced from third parties or generated from available data. Unless expressly stated otherwise, these are indicative only and may exclude taxes, registration, insurance, financing, accessories, delivery and other charges. You must confirm all material information with the relevant third-party provider before entering into a transaction.

7. PROHIBITED CONDUCT

You must not use the Services for unlawful, fraudulent, deceptive, abusive or harmful purposes; impersonate another person; post false listings or reviews; upload malware; bypass security controls; scrape or harvest data without authorisation; use data for unsolicited marketing; infringe rights; or facilitate illegal financing, money laundering, tax evasion or unlawful sale or transfer of vehicles.

8. INTELLECTUAL PROPERTY

Farmjunction and its licensors own all rights in the Services, including software, design, interfaces, databases, trademarks, logos, text, content, graphics, images and compilations. Subject to these Terms, Farmjunction grants you a limited, non-exclusive, non-transferable and revocable licence to access and use the Services for personal or legitimate internal business purposes.

9. PRIVACY AND COMMUNICATIONS

We process Personal Data in accordance with its Privacy Policy. By submitting an enquiry or requesting a Service, You authorize Farmjunction to use your contact and transaction-related information to respond to your request. We may use the contact details as provided by you to send an automated confirmation message via WhatsApp and, where necessary, share it with the relevant third-party service provider and as detailed in Privacy Policy. Marketing or any communications will be sent only as permitted by applicable law, and you may opt out as stated in the Privacy Policy via relevant communication.

10. FEES AND PAYMENTS

Certain Services may involve listing fees, advertising fees, subscription fees, inspection charges, service fees, commissions, payment-processing charges or other charges. Applicable price, taxes, payment terms, cancellation terms and refund conditions will be displayed before payment or set out in a separate written agreement. Unless stated otherwise or required by law, payments made for completed Services are non-refundable.

11. SUSPENSION AND TERMINATION

We may suspend, restrict or terminate access, remove content, cancel a listing or take another appropriate action where you breach these Terms or law; we suspect fraud, impersonation, suspicious activity, abuse or a security threat; information submitted is false or misleading; action is needed to protect users or the Services; or we are required to act by law, court order, regulator or law-enforcement authority.

12. DISCLAIMERS

The Services are provided on an “as is” and “as available” basis to the maximum extent permitted by law. Farmjunction does not guarantee uninterrupted, error-free, secure or always-available operation; or the accuracy, completeness, legality, condition, quality, safety, roadworthiness, title, fitness, merchantability, availability or suitability of any listing, vehicle, equipment, seller, buyer, dealer, lender, insurer or other third-party provider.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Farmjunction, its group entities, directors, officers, employees, agents and licensors will not be liable for indirect, incidental, consequential, special, exemplary or punitive losses, including loss of profits, business, opportunity, goodwill, data or anticipated savings. Farmjunction’s aggregate liability will not exceed the lower of the amount paid by you for the specific Service during the preceding 12 months. This does not apply to liability that cannot be limited or excluded by law.

14. INDEMNITY

You agree to indemnify and hold harmless Farmjunction, its group entities, directors, officers, employees and agents from claims, losses, liabilities, damages, penalties, costs and expenses arising from your use or misuse of the Services; User Content; listings; representations; transactions; breach of these Terms or law; or false, misleading, unauthorised or unlawful information provided by you.

15. CHANGES

We may modify, suspend, discontinue or update the Services or these Terms from time to time. We will publish revised Terms with an updated Last Updated date and, where required by law, give additional notice. Continued use after revised Terms become effective constitutes acceptance.

16. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India. Subject to applicable law, courts located in Alwar, Rajasthan will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services.
