The term “We” / “Us” / “Our” used in this Privacy Policy refers to FarmJunction and its subsidiaries, Agro Wheels Marketing Private Limited and Yellowtork Technology Private Limited and “You” / “Your” / “Yourself” refers to the users, who visit, access, use or avail any service or product on or through any website, mobile site or application owned or administered by Farmjunction (collectively “Service(s)”).

1.5. Please read this Privacy Policy carefully. The Company is committed to protecting the privacy and security of Your personal information. This Privacy Policy is intended to provide You with information on how We collect, use, and protect Your personal information and sensitive personal data or information (“Information”) in compliance with the Information Technology Act, 2000, and the Information Technology (Reasonable security practices and procedures and sensitive personal data or information data or information) Rules, 2011 (“SPDI Rules”) and, as applicable, the Digital Personal Data Protection Act, 2023 (“DPDPA”) and the rules made therein as notified from time to time. The Policy has been designed and developed to help you understand the type of Information we collect from users; the purpose of collection, the means and modes of usage of such Information by the Company; how and to whom the Company will disclose such Information; and how You may access/and or modify this Information.

2. WHAT INFORMATION IS COLLECTED

2.1. Information collected through direct interaction

• (a) When You register to use any Service, We may collect Your first name, last name, email address, mobile number, and location. We may also collect details of family members, legal heirs, nominees, guarantors, nominees, joint policyholders, beneficiaries, authorized or habitual drivers, emergency contacts, references, or any other person whose Information is reasonable required in connection with registration, insurance, financing, compliance or related Services.

• (b) In the event You register using any social media, We may collect the username associated with the social media You choose to register for any Service.

• (c) We may collect your passwords and KYC documents and any other identifier we are lawfully required to collect in relation to authentication or verification of Your identity or credentials.

• (d) We may collect and maintain records of communications with You for inquiry handling, quality assurance, dispute resolution, training, compliance, and administration of Services, subject to notice and consent where mandated by applicable law.

• (e) When You use Our Services for listing any vehicles, We may collect the following Information set out below:

  • (i) Vehicle Registration and Ownership Data: Registration number, chassis/engine identifiers where applicable, ownership history/number, hypothecation/financier details, blacklisting status, and related RTO records;

  • (ii) Insurance & Compliance Certificates: Current insurance policies/certificates, fitness certificates, pollution under control certificates (PUCC), and transfer certificates;

  • (iii) Service, Maintenance & Repair Records: Service/maintenance history, repair/accident records, odometer readings, structural/engine/gear/transmission work, workshop records, and related

  • (iv) OEM & Technical Specifications: Manufacturer-installed features/specifications, modifications, conversion/adaptation history.; and

  • (v) Vehicle History Data & Other Related Data: Historical ownership and usage records and any other data reasonably connected to vehicle ownership, use, compliance, valuation, transfer, or future services of the Company (including records derived or obtained from official, authorised, or commercially available sources).

2.2. Automatically Collected Data

We also collect certain Information when You visit, use, or navigate any website or application owned by the Company. This Information may not reveal specific identity but may include the Information set out below.

• (a) Log and Usage Data: We automatically collect and process Information such as the IP address of the device used, time zone, and operating system. We also collect and store Your login Information (registration date, date of last password change, date of the last successful login) along with the type and version of Your browser.

• (b) Location Information: We automatically collect and process Information about Your actual location. We use various technologies to determine Your location, including IP address, Wi-Fi access points, GPS and mobile towers. You have the option to change this later by going to the settings on the website or application and disabling the permissions related to location sharing. We only collaborate with other legally compliant entities that use Your Information solely for the purpose of providing You with relevant offers and Services.

(b) We may contact You through Your registered mobile number or email id to take feedback from You about Our Services.

(c) We may contact You using Your email id or mobile number to share various products and Services that may be of interest to You or to address queries or resolve any concerns You may raise. We process the above Information based on Our legitimate interest in undertaking marketing activities to offer You Services that may be of Your interest.

(d) You can ask Us to stop sending You such marketing communication at any time by: (i) clicking on the opt-out link in the email sent to You; (ii) changing Your notification settings in Your account; or (iii) by stating to Our calling agent that You do not wish to be contacted for the above marketing communications.

Your consent under this Policy expressly permits the Company to collect, receive from authorised sources, store, process, use, and share in accordance with this Policy all related data, including but not limited to dependent/associated individuals’ details, vehicle registration particulars, insurance policies and certificates, fitness/PUCC, transfer certificates, service/maintenance and repair history, accident history, odometer/usage records, OEM specifications and modifications, vehicle history data, and any other related or reasonably foreseeable data required for current or future business operations or services of the Company.

6. JOB APPLICANTS

If your Information is submitted to us through our Service when applying for a position with Our company, the information will be used to consider your application. We may retain your Information for any period of time. This Information may be shared with other companies for the purpose of evaluating your qualifications for the particular position or other available positions, as well as with third-party service providers retained by us to collect, maintain and analyze candidate submissions for job postings.

7. PERMISSIBLE AGE

The Services are not intended for users under the age of 18, unless permitted under applicable local laws (Permissible Age). We do not knowingly collect any personal information from users or market to or solicit information from anyone under the Permissible Age. If we become aware that a person submitting personal information is under the Permissible Age, we will delete the account and any related information as soon as possible. 9.1. The Company has implemented and maintains reasonable security practices and procedures, including administrative, physical, and technical safeguards, to protect Your Information from unauthorized access, use, disclosure, alteration, or destruction. These include robust administrative, physical, and technical safeguards such as encryption, access control policies, firewalls, and regular security audits to protect Your Information against unauthorized access, disclosure, alteration, or destruction. Our security measures are in compliance with the SPDI Rules and the DPDP Act (to the extent applicable) and are regularly reviewed and updated.

9.2. Please note, despite the measures We have implemented to protect Your Information, the transfer of Information through the internet or other open networks is never completely secure and there is a risk that Your Information may be accessed by unauthorized third parties.

10. YOUR RIGHTS

You may exercise the rights set out below in respect of Your Information, subject to applicable law and the terms of this Policy.

(a) Right to Not Provide Information: You have the option to not provide the Information requested by the Company. However, please be aware that failure to provide Information that is essential for the provision, operation, or administration of the Services may prevent the Company from offering certain Services to You or administering its relationship with You effectively.

(b) Right to Access and Portability: You have the right to access your Information and request a copy of Your Information from the Company for sharing with third parties.

11.3. In case the Information cannot be deleted (for example, due to storage on backup archives), the Company shall endeavour to securely store the Information and isolate it from further processing until deletion is possible.
